EPA UPDATES SW-846 MANUAL

On November 27, 2000, EPA published a notice (65 FR 70678) in the Federal Register announcing that the Draft Update IVB to the Third Edition of the methods manual, "Test Methods for Evaluating Solid Waste, Physical/Chemical Methods" (EPA publication SW-846) was available for review and comment. EPA Publication SW-846 contains EPA-approved sampling and analysis methods that are used to comply with RCRA. The manual was updated in response to language the Senate Appropriations Committee included in a report on a Bill which required EPA to publish an update within 30-days of enactment of the Bill. President Clinton signed the Bill on October 27, 2000. The draft update revises seven of 13 chapters. It also revises 15 test or sampling preparation methods and proposes to add 12 new methods. Additionally, it includes four methods EPA has developed for use in determining air pollution from hazardous wastes.

Draft Update IVB is being released as guidance only. The methods in the draft can be used in all applications for which the use of SW-846 methods are not mandatory under RCRA and for which they are effective. EPA has indicated in the notice that facilities should consult with the appropriate regulating entities before using these methods to comply with the regulation. EPA also indicated in the notice that it is changing its approach on releasing future SW-846 updates. The Agency is currently developing a proposed rule to remove unnecessary required uses of SW-846 methods from the RCRA regulation. If the rule is finalized, EPA will generally only require the use of a particular method when it is referenced specifically in the regulation. EPA REVISES THE METHODOLOGY FOR DERIVING AMBIENT WATER QUALITY CRITERIA FOR HUMAN HEALTH

On November 3, 2000, EPA published a notice (65 FR 66444) in the Federal Register announcing that the final revisions to the Methodology for Deriving Ambient Water Quality Criteria for the Protection of Human Health (2000 HH Methodology) was available. The 2000 HH Methodology supersedes the existing guidelines entitled, "Guidelines and Methodology Used in the Preparation of Health Effects Assessment Chapters of the Consent Decree Water Criteria Documents," published by EPA in November 1980. EPA has revised the Human Health Methodology as required by Section 304(a)(1) of the Clean Water Act, which states that EPA must periodically update the water quality criteria to accurately reflect the latest knowledge on the extent and kind of identifiable effects of pollutants in a water body for health and welfare.

Human health ambient water quality criteria are numeric values for pollutant concentrations in ambient waters considered to be protective of human health. The criteria are based solely on data and scientific judgments on the relationship between pollutant concentrations and environmental and human health effects. The criteria are used by States and Tribes to establish water quality standards and provide the basis for controlling discharges or releases of pollutants. The criteria also provide guidance to EPA when promulgating federal regulations. The HH Methodology is used by EPA to derive or revise the human health criteria. It provides the means for developing water quality criteria, including procedures for evaluating cancer risk, non-cancer health effects, human exposure and bioaccumulation in fish. The HH Methodology is also used as guidance by States and Tribes for establishing human health water quality criteria. EPA has stated in the notice that the revisions to the 2000 HH Methodology are not regulations and do not impose legally binding requirements on EPA, States, Tribes or the public. ECOLOGY RELEASES THE FINAL DRAFT STORMWATER MANUAL

Ecology recently released the final draft Stormwater Manual for Western Washington, which will replace the current manual, "Stormwater Management Manual for the Puget Sound Basin" (1992 Manual) published in 1992. The 1992 Manual has been used by businesses and local jurisdictions throughout the state including eastern Washington to design stormwater programs to protect the state's waters. Ecology is revising the 1992 Manual to include more current research in the area of stormwater runoff, to satisfy new requirements of the Endangered Species Act, to anticipate new federal stormwater rules which will require the use of a more technically sound manual, and to broaden the applicability of the manual to areas outside the Puget Sound area. Key changes of the manual include:

Ecology published an initial draft in the fall of 1999 and held public workshops. Public input from these workshops, as well as input from advisory committees, has been incorporated into this final draft. Ecology will be developing a separate Manual for Eastern Washington, which will be completed in October 2002. Until it is completed, the Stormwater Manual for Western Washington will be used statewide. On November 1, 2000, EPA published a notice announcing that it was planning to submit an Information Collection Request (ICR) on the Alternate Threshold for Low Annual Reportable Amounts: Toxic Chemical Release Reporting to the Office of Management and Budget (OMB) for review and approval. EPA is requesting OMB to renew the existing approval for the ICR for three years. Comments on the ICR must be received by EPA on or before December 1, 2000.

On November 2, 2000, EPA published a notice announcing that an ICR on Land Disposal Restrictions has been forwarded to OMB for review and approval. EPA is requesting an extension of the current ICR on record keeping for LDR. Comments on the ICR must be received by EPA on or before December 4, 2000.

On November 3, 2000, EPA published a notice announcing that the final revisions to the Methodology for Deriving Ambient Water Quality Criteria for the Protection of Human Health 2000 is available (see article, this edition). On November 7, 2000, EPA published a proposed rule establishing national emission standards for hazardous air pollutants for municipal solid waste (MSW) landfills. The proposed rule is applicable to both major and area landfills and contains the same requirements as the Emission Guidelines and New Source Performance Standards for MSW landfills. It adds startup, shutdown, and malfunction requirements, adds operating condition deviations for out-if-bounds monitoring parameters, and changes the reporting frequency for one type of report. Comments on the proposed rule must be received by EPA on or before January 8, 2001.

On November 7, 2000, the Nuclear Regulatory Commission (NRC) published a notice announcing that it is developing an approach for using risk information in the nuclear materials regulatory process. As part of this effort, the NRC has developed a plan that uses case studies to examine the use of risk information in the nuclear materials and waste arenas. The notice includes the final plan.

On November 7, 2000, the Army Corp of Engineers, EPA, Fish and Wildlife Service, and National Marine Fisheries Service published a notice announcing that their final policy guidance on the use of in-lieu-fee arrangements to be used as compensation for adverse impacts to wetlands and other aquatic resources under the Clean Water Act Section 404 and Rivers and Harbors Act Section 10 was available. This action clarifies the manner in which in-lieu-fee mitigation may serve as a useful approach to satisfy compensatory mitigation requirements and meet EPA's goal of no overall net loss of wetlands. The action became effective October 31, 2000.

On November 9, 2000, EPA published a clarification to the original intent of the revised standards for hazardous waste incinerators, hazardous waste burning cement kilns, and hazardous waste burning lightweight aggregate kilns published in the Federal Register on September 30, 1999 (64 FR 52828). EPA is also making certain technical corrections. The final rule became effective November 9, 2000.

On November 13, 2000, EPA published a notice announcing that DOE documents are available on the characterization of transuranic radioactive waste at the Savannah River site proposed for disposal at the Waste Isolation Pilot Plant (WIPP). These documents include: "Savannah River Site WIPP Disposal Program Quality Assurance Project Plan;" "Savannah River Site WIPP Disposal Program Quality Assurance Program Document;" and "Savannah River Site WIPP Disposal Program Waste Certification Plan." EPA is requesting public comment on these documents. Comments must be received by EPA on or before December 13, 2000. On November 15, 2000, EPA published a notice announcing that the Forty-Fourth Report of the Toxic Substances Control Act Interagency Testing Committee is available for review and comment. Comments on the report must be received by EPA on or before December 15, 2000.

On November 16, 2000, EPA published a proposed action that has determined that the Wallula non-attainment area has not attained the National Ambient Air Quality Standards for PM-10 particulate matter by the attainment date of December 31, 1997 as required by the Clean Air Act (CAA). If EPA takes final action on this proposal, the Wallula PM10 non-attainment area will be reclassified as a serious PM10 non-attainment area. Comments on the proposed action must be received by EPA on or before December 1, 2000.

On November 17, 2000, EPA published a notice announcing that it was extending the comment period for the submission of scientific and technical information for the development of revised Ambient Water Quality Criterion for Methylmercury until November 27, 2000. On November 20, 2000, EPA published a notice announcing that a draft document entitled: "Benchmark Dose Technical Guidance Document" is available for review and comment. The purpose of the document is to provide guidance for EPA on the application of the benchmark dose approach in determining the point of departure. On November 28, 2000, EPA published a direct final rule revising the accelerated phase-out regulations that govern production, import, export, transformation and destructions of substances that deplete the ozone layer under Title VI of the CAA. The revision directs EPA to conform to the schedule for industrialized nations under the Montreal Protocol for class I, Group VI controlled substances (methyl bromide). The final rule will become effective January 29, 2001 unless adverse comments are received by EPA on or before December 28, 2000. Elsewhere in this same federal register (65 FR 70828), EPA has published a proposed rule in the event it receives adverse comments on this action.

On November 28, 2000, EPA published a notice announcing that DOE documents are available on waste characterization programs for certain transuranic radioactive waste at the Idaho National Engineering and Environmental Laboratory (INEEL) proposed for disposal at the WIPP. These documents include: "Quality Assurance Project Plan for the Transuranic Waste Characterization Program;" "INEEL Transuranic Waste Characterization, Transportation, and Certification Quality Program Plan;" and "Program Plan for Certification of INEEL Contact-Handled Stored Transuranic Waste." On November 28, 2000, EPA published a notice announcing that draft guidance documents on persistent bioaccumulative toxic chemicals that are subject to reporting under the Emergency Planning and Community Right to Know are available for review and comment. Draft guidance documents on the mercury and mercury compounds category, the polycyclic aromatic compounds category and the pesticides and other persistent bioaccumulative toxic chemicals are available from the Internet at http://www.epa.gov/tri. Comments must be received by EPA on or before December 28, 2000.

On November 1, 2000, the Department of Labor and Industries (L&I) published a proposed rule to amend Chapter 246-46 WAC, Safety Standards-Installing Electric Wires and Equipment and Chapter 296-401A WAC, Certification of Competency for Journeyman Electricians. The amendment will incorporate policy into rule as directed by Governor's Executive Order 97-02 on regulatory improvement; adopt by reference national consensus codes; establish a new regulatory framework for telecommunications installation, etc. The rulemaking will repeal Chapters 296-46 and 296-401A WACs and replace them with new Chapters 296-46A and 296-401B WAC respectively. Comments on the proposed rule must be received by L&I on or before November 30, 2000.

On November 1, 2000, the L&I published a proposed rule amending Chapters 296-155-205, Head Protection, 296-155-305 WAC, Signaling, Flaggers, and 296-155-625, Site Clearing. The purpose of the rule is to comply with the requirements of Chapter 239, Laws of 2000 (ESHB 2647) that directed the Department to adopt permanent rules by March 1, 2001, revising any safety standard governing flaggers. Comments on the proposed rule must be received by Ecology on or before December 6, 2000.

On November 1, 2000, the Department of Health published a proposed rule amending Chapter 246-292 WAC, Water Works Operator Certification. The purpose of the proposed rule is to adopt the 1996 amendments to the Safe Drinking Water Act regarding operator certification requirements as specified by EPA guidance. Comments on the proposed rule must be received by EPA on or before December 8, 2000.

On November 1, 2000, L&I published its final rule amending Chapter 296-62 WAC, General Occupational Health Standards. The purpose of the rule amendment was to clarify certain language of the rule under the respiratory protection provisions. The final rule becomes effective January 1, 2001.
