ECOLOGY PUBLISHES FINAL REVISIONS TO THE NEW SOURCE REVIEW PROVISIONS OF THE GENERAL REGULATION FOR AIR POLLUTION SOURCES

On January 7, 1998, Ecology published the final revisions to the new source review (NSR) provisions of Chapter 173-400 WAC, the General Regulation for Air Pollution Sources, in the Washington State Register (98-01-183). The amendments are part of Ecology's regulatory reform effort to streamline these provisions and provisions of Chapter 173-460 WAC, Controls for New Sources of Toxic Air Pollutants (TAPS). The rule will became effective on January 23, 1998. Fluor Daniel Hanford's Environmental Protection will closely follow how Ecology interprets the revised language. ECOLOGY PUBLISHES FINAL AMENDMENTS TO THE DANGEROUS WASTE REGULATIONS

On February 4, 1998, Ecology published the final amendments to Chapter 173-303 WAC, the Dangerous Waste Regulations, in the Washington State Register (98-03-018). The amendments update the dangerous waste regulations by incorporating several federal hazardous waste requirements. Those that may affect Hanford include:

Ecology also made changes to the state-only provisions of the rule to allow for a conditional exclusion of spent antifreeze that is recycled on-site or sent off-site for recycling. The final rule amendments become effective on February 12, 1998. Ecology has also finalized the Chemical Test Methods document and intends to have it mailed out by mid-February. On January 2, DOE published a notice announcing that it has submitted the implementation plan on "Criticality Safety at Defense Nuclear Facilities in the DOE Complex" to the Defense Nuclear Facilities Safety Board on December 12, 1997. This implementation plan is available for review in the DOE Public Reading Rooms including the Hanford Reading Room and on the Internet at http://dr.tis.doe.gov/.

On January 5, DOE published a notice it is interested in receiving grant applications for performance of innovative, fundamental research to support activities for high level radioactive waste including characterization and safety, retrieval of tank waste and tank closure, pretreatment, and waste immobilization and disposal. All preapplications should be sent to Dr. Roland F. Hirsch, ER-73, Mail Stop F-240, Office of Biological and Environmental Research, U.S. Department of Energy, 19901 Germantown Road, Germantown, MD 20874-1290. Applications must be received in DOE by April 16, 1998.

On January 9, EPA published its proposed rule to expand the existing stormwater program (Phase I) under the National Pollutant Discharge Elimination System. Under this proposal, the NPDES storm water program (Phase II) will expand to include smaller municipalities and construction sites that disturb 1 to 5 acres. The proposed rule would also allow certain sources to be either included because of adverse impact or excluded because of the lack of impact on water quality in a local area. In addition, EPA is conditionally excluding industrial facilities that have "no exposure" of industrial activities to storm water. Comments on this proposed rule must be received in EPA by April 9, 1998.

On January 16, EPA published a direct final rule amending 40 CFR Part 81 to identify ozone areas where the one-hour standard is no longer applicable. This regulation is the result of President Clinton's memorandum of July 16, 1997 which directed EPA to identify ozone areas where the one-hour standard will not apply because it has not measured a violation of the standard. Because EPA anticipates no adverse comments, it is approving the amendment as a direct final rule without prior proposal. However, EPA is also publishing a proposed rule in this same Federal Register in the event adverse comments are received. The direct final rule becomes effective March 17, 1998.

On January 16, EPA published a proposed rule amending 40 CFR Part 81 to identify ozone areas where the 1-hour standard is no longer applicable. This action is also intended to assist in phasing out the 1-hour standard in favor of the new 8-hour standard recently promulgated. Elsewhere in this same register, EPA has published a direct final rule. If no adverse comments are received on the direct final rule, then no further action will occur on this proposed rule. If adverse comments are received, then the direct final rule will be withdrawn and rulemaking will continue on this proposed rule. Comments on the proposed rule must be received in EPA by February 17, 1998.

On January 21, DOE published a notice announcing that it intends to prepare an Environmental Impact Statement (EIS) for the production of tritium using one or more commercial light water reactors (CLWR). The EIS will evaluate the environmental impacts of tritium production for all reasonable alternatives. DOE plans to have scoping meetings in Alabama on February 24, 1998 and Tennessee on February 26, 1998. Comments can be submitted to: Stephen M. Comments on this action must be received in DOE by March 20, 1998.

On January 23, DOE published its record of decision (ROD) to dispose of transuranic waste (TRU) at the Waste Isolation Pilot Plant in Carlsbad, New Mexico. Under this decision, DOE will dispose of up to 175,000 cubic meters of TRU at the facility. The ROD documents DOE's decision to implement the preferred alternative in the EIS and is being issued in coordination with the preparation of a ROD on the treatment and storage of TRU in the Waste Management Programmatic EIS. Implementation of this decision is contingent upon DOE obtaining a Compliance Certification from EPA. On January 23, DOE published a record of decision on where it will prepare and store TRU waste prior to disposal. Each of the sites that currently have or will generate TRU waste will prepare and store it on site, except the Sandia National Laboratory which will transfer it's waste to Los Alamos National Laboratory in New Mexico. The decision was based on analyses of the Final Programmatic Waste Management EIS and other information. This ROD differs slightly from the Preferred Alternative in the EIS.
