EPA ISSUES EFFLUENT LIMITATIONS GUIDELINES
AND PRETREATMENT STANDARDS FOR LANDFILL WASTEWATER DISCHARGES
On January 19, 2000, EPA published a final rule in the Federal Register
(65 FR 3008) establishing national effluent limitations guidelines and
pretreatment standards for wastewater discharges from new and existing
hazardous and nonhazardous landfills regulated under Subtitles C and D of
RCRA. In this final rule, EPA promulgates technology-based effluent
limitations for wastewater discharges to navigable waters from these
landfills. Sources of landfill wastewater include landfill leachate, gas
collection condensate, truck/equipment wash water, drained free liquids,
laboratory waste waters and contaminated storm water. The rule does not
apply to "captive" landfills associated with commercial or
industrial activities or wastewater discharges associated with treatment
of contaminated ground water from hazardous and non-hazardous landfills.
EPA has also included in the publication several documents that further
describe the technical and economic basis for the rule promulgation
including:

ECOLOGY TO HOLD PUBLIC HEARINGS ON THE
DANGEROUS WASTE RULE AMENDMENTS
Ecology will be holding public hearings in February on the proposed
Dangerous Waste regulation amendments. The proposed amendments were
published in the Washington State Register on January 19, 2000 (WSR
00-02-081). Ecology is proposing to incorporate several recent
federal rules including the Universal Waste rule, Phase III and IV Land
Disposal Restrictions standards, Subpart CC air emission standards,
portions of the Hazardous Waste Identification rule and Post-Closure rule,
the Military Munitions rule and the Used Oil rule with some modifications.
Ecology is also making certain state-only changes including amendments to
the transporter requirements, elimination of the exemption for fertilizers
made from steel mill flue dust; new provision to subject fertilizers made
from state-only wastes to the federal land disposal requirements; and
incorporation of the criteria that are used to review applications for
hazardous waste derived fertilizers.
The public hearings will be held in Bellingham on February 10, 2000,
Burien on February 15, 2000, and in Lacey/Spokane/Kennewick on February
16, 2000. The public hearing in Kennewick will be held at DIS Interactive
Technologies, 8551 W. Gage Blvd., Suite H at 7pm.

ECOLOGY ISSUES FINAL RULE AMENDING THE
WASTEWATER DISCHARGE FEES
On January 19, 2000, Ecology published a final rule in the Washington
State Register (WSR 00-02-031) amending Chapter
173-224 WAC, Wastewater Discharge Permit Fees. The final rule includes
amendments that:
- add four new fee categories including noncontact cooling water with
additives general permit, aggregate production individual permit
coverage for portable rock crushing, asphalt batch plant, and concrete
batch plant facilities;
- amend the existing dairy category;
- develop a definition for portable facility; and
- allow for automatic fee changes to match the state fiscal growth
factor.
The fees for the 1999-2001 biennium will increase by 3.32% in FY 2000,
2.87% in FY 2001 and 2.66% in FY 2002. The final rule becomes effective

LEGISLATIVE UPDATE
The 2000 legislative session began January 10, 2000. Since then, there
have been a number of environmental bills that have been introduced that
may have an impact on Hanford. These include:
- HB 2421. This bill creates new provisions on air pollution control
including new provisions on outdoor burning.
- HB 2479. This bill establishes a pilot project to allow a county to
administer hydraulic permits.
- HB 3056. This bill requires that the burden of the total maximum
daily load program be shared among contributors in proportion to their
contribution and in consideration of equitable factors and natural
background.
- SB 6209. This bill authorizes the development of a proposal for an
environmental quality benchmarks program for future legislative
consideration.
- SB 6489. This bill would prohibit the use of mixing zones for
persistent bioaccumulative toxic pollutants;
- SB 6521. This bill allows the fish and wildlife to issue stop work
orders on hydraulic permits.
- SB 6525. This bill adds new provisions to water right regulations and
prioritizes the processing of applications for water rights changes and
transfers.
- SB 6542. This bill expands the citizen suit provisions of several
environmental regulations.
- SB 6814. This bill relates to the protection of the Columbia River
from contamination of improperly stored or disposed of mixed radioactive
and dangerous wastes and the release or threatened release of hazardous
substances.

Briefly
EPA will be updating scientific information on 21 chemicals and
pesticides listed in its Integrated Risk Information System (IRIS). The
IRIS database provides health effects information on over 500 substances.
A notice of the agency's plans was published in the federal register on
January 12, 2000 (65 FR 1863). The notice
outlines the agency's plans for this next year, asks for scientific data
from the public that would support the IRIS update and announces that the
IRIS agenda will be published in the federal register annually.

- 65 FR 1366
- On January 10, 2000, EPA published a notice announcing that
it was seeking public comment on an Information Collection
Request (ICR) on PCBs: Consolidated Reporting and Recordkeeping
Requirements. The information collected under the ICR will
assist EPA in preventing improper handling and disposal of PCBs
and will minimize PCB exposure to human beings or the
environment. Comments on the notice must be received by EPA on
or before March 10, 2000.
- 65 FR 1814
- On January 12, 2000, EPA published a direct final rule to
streamline the approval process for specific state permit
programs for solid waste disposal facilities other than
municipal solid waste landfills that receive conditionally
exempt small quantity generator hazardous waste. The direct
final rule becomes effective April 11, 2000, unless EPA receives
adverse comments by February 11, 2000. Elsewhere in this federal
register, EPA has published a proposed rule (64 FR 1842) for
this same action.
- 65 FR 1863
- On January 12, 2000, EPA published a notice announcing that a
new set of chemical health assessments for the IRIS has been
prepared. Comments must be received by EPA on or before March
13, 2000.
- 65 FR 1950
- On January 12, 2000, EPA published a final rule to revise the
national primary drinking water regulations for lead and copper.
The revisions are intended to improve implementation of the
regulations. The final rule amendment will become effective
April 11, 2000.
- 65 FR 2162
- On January 13, 2000, EPA published a notice announcing that
it was submitting an ICR to the Office of Management and Budget
(OMB) on the State Water Quality Program Management Gap Analysis
for review and approval. Comments on the ICR must be received by
EPA on or before March 13, 2000.
- 65 FR 2388
- On January 14, 2000, EPA published a notice announcing that
it has submitted an ICR to OMB for review and approval of Part B
Permit Application, Permit Modifications and Special Permits
which expires March 31, 2000. Comments on the ICR must be
received by EPA on or before February 14, 2000.
- 65 FR 3008
- On January 19, 2000, EPA published a final rule which
established technology-based effluent limitations for wastewater
discharges from new and existing hazardous and non-hazardous
landfills regulated under Subtitle C and Subtitle D of RCRA (see
article, this edition). The final rule becomes effective
February 18, 2000.
- 65 FR 3432
- On January 21, 2000, DOE published a notice announcing that
the Idaho High-Level Waste and Facilities Disposition Draft
Environmental Impact Statement was available for public review
and comment. Comments on the draft EIS must be received by DOE
on or before March 20, 2000.
- WSR 00-01-078
- On January 5, 2000, Ecology announced that it was withdrawing
the proposed rule to amend Chapter 173-400 WAC, the General
Regulations for Air Pollution Sources. The proposed rule would
have corrected typographical errors, clarified existing rule
language, and adopted certain federal requirements. The proposed
rule was withdrawn by the code reviser's office since it was not
adopted within the one hundred eighty-day period allowed by the
statute.
- WSR 00-01-080
- On January 5, 2000, Ecology announced it was withdrawing the
proposed rule which would have allowed counties to establish
local water conservancy boards to process water right transfer
and change applications under Chapter 173-153 WAC. The proposed
rule was withdrawn by the code reviser's office since it was not
adopted within the one hundred eighty-day period allowed by the
statute.
- WSR 00-02-081
- On January 19, 2000, Ecology published proposed amendments to
the Dangerous Waste Regulation, Chapter 173-303 WAC (see
article, this edition). The proposed rule incorporates
federal hazardous waste requirements and amends some State-Only
requirements. Comments must be received by Ecology on or before
February 29, 2000.
- WSR 00-02-015
- On January 19, 2000, DOH published a final rule that
increases fees for review and approval of water system plans,
project reports, construction documents, existing systems, and
related evaluations under Chapters 246-290 WAC and 246-292 WAC.
The final rule became effective January 28, 2000.
- WSR 00-02-031
- On January 19, 2000, Ecology published the final rule to
amend Chapter 173-224 WAC, the Wastewater Discharge Permit Fees
(see article, this edition). The
final rule increases fees, creates four new fee categories, and
amends the dairy category. The final rule became effective
January 28, 2000.
