EPA PUBLISHES AN ADVANCED NOTICE OF PROPOSED RULEMAKING TO AMEND THE LAND DISPOSAL RESTRICTIONS OF RCRA

On June 19, 2000, EPA published an advanced notice of proposed rulemaking (ANPR) in the Federal Register (65 FR 37932) discussing the issues EPA is requesting public input on to amend the Land Disposal Restrictions (LDR) program under RCRA. These issues came from interviews the Agency conducted with EPA Headquarters, EPA Regions, States, and LDR experts in the regulated community and environmental groups. EPA also used recommendations from the LDR Roundtable which met in 1993 and again in 1998 to discuss LDR issues, and information from site visits EPA staff made to several generator and treatment facilities. The issues, in the ANPR EPA is requesting public input on, include:

Comments on the ANPR must be received by EPA on or before September 18, 2000. ECOLOGY ADOPTS FINAL DANGEROUS WASTE REGULATIONS

On June 7, 2000, Ecology published the final amendments to the Dangerous Waste Regulations in the Washington State Register (WSR 00-11-040). The final rule incorporates new federal and certain state-only requirements including:

On June 6, 2000, EPA published a notice announcing that its Benchmark Dose Software (BMDS Version 1.2) was available. This software was developed as a tool to facilitate the application of benchmark dose methods to the assessment of hazardous pollutants. The software can be found on the Internet at http://www.epa.gov/ncea/bmds.htm.

On June 13, 2000, EPA published a withdrawal of a direct final rule amending the Interim Enhanced Surface Water Treatment Rule, The Stage 1 Disinfectants and Disinfection Byproducts Rule and the State Primacy requirements to implement the Safe Drinking Water Act amendments. This rule was published in the Federal Register on April 14, 2000 (65 FR 20304) and is being withdrawn as a result of numerous adverse comments EPA received.

On June 13, 2000, EPA published a notice to reopen the public comment period on the proposed rule to revise the Interim Enhanced Surface Water Treatment Rule, the Stage 1 Disinfectants and Disinfection Byproducts Rule and the State Primacy Requirements to implement the safe drinking water act amendments. This proposed rule was published in the Federal Register April 14, 2000 (65 FR 20314). EPA is reopening the comment period to allow all interested persons to submit written comments. Comments must be received by EPA on or before July 13, 2000.

On June 13, 2000, EPA published a notice announcing that it was planning to submit an Information Collection Request (ICR) on the Notification of Episodic Releases of Oil and Hazardous Substances to the Office of Management and Budget (OMB) for review and approval. Comments on this ICR must be received by EPA on or before August 14, 2000.

On June 13, 2000, EPA published a notice announcing that it was planning to submit an ICR on Continuous Release Reporting Regulations under CERCLA to OMB for review and approval. Comments on the ICR must be received by EPA on or before August 14, 2000.

On June 14, 2000, EPA published a notice extending the comment period for the proposed ground water rule from July 10, 2000, to August 9, 2000. The rule was published in the Federal Register on May 10, 2000 (65 FR 30194) and contains requirements that reduce the public health risk from fecal contamination of community ground water supplies. Comments must be received by EPA on or before August 9, 2000.

On June 16, 2000, EPA published a notice extending the comment period for the proposed revisions to the Clean Water Act regulatory definitions of "fill material" and "discharge of fill material" from June 19, 2000, to July 19, 2000. Comments must be received by EPA on or before July 19, 2000.

On June 16, 2000, EPA published a notice announcing that the Effluent Guidelines Plan was available for public review and comment. On June 19, 2000, EPA published a notice expanding the list of acceptable substitutes for ozone-depleting substances under EPA's Significant New Alternatives Policy program. The list became effective June 19, 2000.

On June 22, 2000, EPA published a notice of proposed rulemaking to establish a drinking water regulation for arsenic as required by the 1996 Safe Drinking Water Act amendments. Comments on the proposed rulemaking must be received by EPA on or before September 20, 2000.

On June 23, 2000, EPA published a notice announcing its plans to submit an ICR on the 2001 Hazardous Waste Report to OMB for review and approval. Comments on the ICR must be received by EPA on or before August 22, 2000.

On June 23, 2000, EPA published a notice containing Acute Exposure Guideline Levels (AEGLs) values and executive summaries for 14 chemicals. The notice requests public review and comment on these AEGLs. Comments on the AEGLs must be received by EPA on or before July 24, 2000.

On June 23, 2000, EPA published a notice announcing that it will be holding a public hearing on the National Emission Standards for Hazardous Air Pollutants: Standards for Emissions of Radionuclides other than Radon from DOE Facilities and Standards for Radionuclide Emissions from Federal Facilities other than Nuclear Regulatory Commission Licensees and not covered by Subpart H. The public hearing was held July 12, 2000 from 9am to 12 pm in Washington, D.C.

On June 27, 2000, EPA published a notice announcing that it is revising the Interim Guidance on the CERCLA Section 101(10)(H) Federally Permitted Release Definition for Certain Air Emissions and will suspend the current guidance until the revised guidance is published. The current Interim Guidance was published in the Federal Register on December 21, 1999 and is being revised as a result of numerous adverse comments EPA received during the comment period and a petition concerned parties filed with the U.S. Court of Appeals for the District of Columbia. EPA intends to have the revised guidance available in late July 2000.

On June 30, 2000, EPA published technical corrections to a final rule published in the Federal Register on May 4, 2000, to revise the public notification requirements for public water systems under the Safe Drinking Water Act amendments. The amended final rule became effective June 30, 2000.
