On October 20, 2004, Ecology published a proposed rule in the Washington State Register (WSR) (WSR 04-20-105) to amend the New Source Review (NSR) provisions of Chapter 173-400 WAC, the General Regulations for Air Pollution Sources. The NSR provisions contain requirements Ecology uses to review and approve construction of new industrial and commercial sources of air pollution, or modifications to existing air emission sources. The proposed rule includes changes that:
Ecology will hold two public hearings to receive comments on the proposed changes. The hearings will be held on November 9, 2004 at 1:30 pm in Ecology's Headquarters Office in Lacey and on November 10, 2004 at 1:30 pm in Ecology's Eastern Regional Office in Spokane. Ecology intends to adopt the rule change by December 29, 2004. Comments on the proposed rule amendments must be received by Ecology on or before November 24, 2004. ECOLOGY RELEASES FINAL STORMWATER MANAGEMENT MANUAL FOR EASTERN WASHINGTON
On November 1, 2004, Ecology issued the Final Stormwater Management Manual for Eastern Washington (Manual). The objective of the Manual is to provide guidance on stormwater design and management in eastern Washington. The Manual provides a commonly accepted set of technical standards in addition to presenting new design information and new approaches to stormwater management. These stormwater management practices are intended to protect water quality in both surface and ground receiving waters. The Manual also provides technically sound and realistic guidance on how to properly manage stormwater runoff from individual project sites.
The Manual identifies eight core elements for managing stormwater runoff from new development and redevelopment projects of all sizes. It also provides guidance for preparation and implementation of stormwater site plans. The requirements of the core elements are generally satisfied by the application of best management practices (BMPs) which are found in the Manual. The Manual can be found on the Internet at http://www.ecy.wa.gov/biblio/0410076.html or a copy can be ordered from the State Department of Printing. Ecology will hold public workshops on November 9, 2004, at 8:30 am to 11 am at the Mukogawa Fort Wright Institute in Spokane; on November 16, 2004 at 9 am to 11:30 am at the Benton County PUD Building in Kennewick; and on December 7, 2004 at the Hal Holmes Conference Center in Ellensburg. On October 1, 2004, Department of Transportation (DOT) published a correction to errors in a final rule (69 FR 58841) published in the Federal Register (FR) on September 13, 2004 amending requirements for the Hazardous Materials Regulation (HMR) pertaining to the transportation of radioactive materials based on changes in the International Atomic Energy Agency (IAEA) publication entitled, "IAEA Safety Standards Series: Regulations for the Safe Transport of Radioactive Material," 1996 Edition, No. TS-R-1. The corrections to the final rule became effective on October 1, 2004.
On October 1, 2004, EPA published a notice of acceptability (69 FR 58903) in the FR expanding the list of acceptable substitutes for ozone-depleting substances under EPA's Significant New Alternatives Policy (SNAP) program. The substitutes are for use in the following sectors: refrigeration and air conditioning, foam blowing, fire suppression and explosion protection, and sterilants. The notice also clarifies the status of the use of a hydrochlorofluorocarbon as an aerosol solvent, revises the global warming potential for a substitute previously listed as acceptable for use in fire suppression and explosion protection based on new information, and clarifies a statement from the previous SNAP notice of acceptability regarding a refrigerant.
On October 6, 2004, Ecology published a notice (WSR 04-19-074) in the WSR announcing that it was extending the comment period on the Dangerous Waste Regulation from September 21, 2004 to September 24, 2004. Comments on the amendments were to be received by Ecology on or before September 24, 2004.
On October 19, 2004, EPA published a notice (69 FR 61476) in the FR announcing that it has posted new applicability determinations, alternative monitoring decision, and regulatory interpretations regarding New Source Performance Standards, National Emission Standards for Hazardous Air Pollutants and the Stratospheric Ozone Protection Program on the Applicability Determination Index (ADI).
On October 20, 2004, Ecology published a notice (WSR 04-21-093) in the WSR announcing that it has completed a statewide water quality assessment including the Section 303(d) list and will be holding public workshops to discuss the information. Workshops will be held November 12, 2004 at the Ecology Headquarters Office in Lacey from 10 am to 12 noon; on November 17, 2004 at the Yakima Convention Center in Yakima from 6:30 pm to 8:30 pm and on November 18, 2004 at Spokane Falls Community College in Spokane from 6:30 pm to 8:30 pm. Ecology will review all comments and make changes to the preliminary list of categories as appropriate. The Agency will then formally submit the final assessment to EPA for review.
On October 25, 2004, EPA published a notice (69 FR 62267) in the FR announcing that it was planning to submit an Information Collection Request (ICR) on Underground Injection Control (UIC) Program to the Office of Management and Budget (OMB) for review and approval. The ICR is scheduled to expire on January 31, 2005. Owners/operators of underground injection wells must obtain permits, conduct environmental monitoring, maintain records, and report results to EPA and the state UIC primacy agency. States also must report to EPA on permittee compliance and related information. The data are used to ensure the protection of underground sources of drinking water from UIC authorities. EPA expects that the total burden for continuing the Program ICR will increase due to additional requirements related to the adoption of the 1999 Class V rule and labor rates. Comments on the ICR must be received by EPA on or before December 27, 2004.
On October 25, 2004, EPA's National Center for Environmental Innovation published a notice (69 FR 62268) in the FR announcing that the Guide to Analyzing Environmental Innovations is available. This Guide includes a set of evaluation modules that outline core questions to be answered as part of any evaluation, either within EPA or outside the Agency. Comments on the guide must be received by EPA on or before November 30, 2004.
On October 29, 2004, EPA published a notice (69 FR 63111) in the FR announcing that the final document entitled, "Air Quality Criteria for Particulate Matter (PM)" is available. PM is one of six criteria pollutants for which EPA has established air quality criteria and National Ambient Air Quality Standards (NAAQS). EPA has revised the existing PM document as part of its current review cycle of the PM criteria and NAAQS, The document can be found on the internet at http://www.epa.gov/ncea/publications.
